Terms of Service
By booking a session with Vining Creative Photography, you agree to these terms. Please read them carefully before scheduling your session.
Session Booking and Deposits
A non-refundable retainer of 50% is due at booking to reserve your date. The remaining balance is due on or before the session date. Your booking is confirmed upon receipt of the retainer.
Cancellation and Rescheduling
- Cancellation 48+ hours before session: Your retainer can be applied to a future date within 6 months.
- Cancellation within 48 hours: The retainer is forfeited.
- Photographer cancellation: You will receive a full refund or the option to reschedule at your preference.
- Rescheduling: One free reschedule per booking is included (weather permitting).
Weather Policy
Outdoor sessions may be rescheduled due to severe weather at no extra charge. Light rain, wind, or overcast skies are generally not cause for rescheduling, as these conditions often create beautiful photos.
Rescheduling decisions are made jointly 24 hours before the session. If we cannot agree, you may reschedule without penalty.
Image Delivery and Timeline
- Edited images are delivered within 2 to 3 weeks of the session date.
- Images are delivered via a private online gallery.
- Your gallery link remains active for 90 days from delivery.
- Rush delivery is available for an additional fee.
Image Usage and Rights
- You receive a personal print release for all delivered images.
- Images may not be used for commercial purposes without a separate commercial license.
- The photographer retains copyright to all images.
- The photographer may use images for portfolio, social media, and marketing unless otherwise agreed in writing.
- Please do not edit, add filters, or crop images for public sharing, as this protects artistic integrity.
Model Release
By booking a session, you grant permission for portfolio and marketing use of the resulting images unless a separate non-disclosure agreement is signed. For sessions involving minors, parent or guardian consent is required.
Limitation of Liability
In the unlikely event of equipment failure or data loss, liability is limited to a reshoot at no cost or a full refund of session fees paid.
The photographer is not responsible for unflattering photos resulting from clothing, location, or styling decisions discussed beforehand.
Payment Terms
- Payment is accepted via credit card, Venmo, or Zelle.
- Packages and pricing are subject to change. Quoted pricing is honored for 30 days from the date of the quote.
Intellectual Property
All content on this website, including text, graphics, logos, and photographs, is the property of Vining Creative Photography and is protected by copyright. You may not reproduce, distribute, or create derivative works from this content without prior written consent.
Changes to These Terms
Vining Creative Photography reserves the right to modify these Terms of Service at any time. Changes will be effective when posted on this page. Your continued use of the site or booking of sessions constitutes acceptance of the revised terms.
